Legal Action is defined as a judicial proceeding brought by one party against another; one party prosecutes another for a wrong doing for protection of a right or for prevention of a wrong.
This is what occurs after a person or company has committed a copyright infringement. This is a punishment to the perpetrator and is decided by a judge after a session in court, a notice and take down process or after a deal has been met between the owner and the opposing party. The perpetrator may face imprisonment or receive fines. Companies also face fines even if their employed software developers are guilty of this even without knowing that this is taking place. This is intended to allow software developers and their companies to feel a sense of safety when releasing their ideas into the world. That their intellectual property is protected by law, thus increasing the likelihood for someone to voice their ideas and in turn help to lead to advancements. This also helps to keep the customer sure they are getting the genuine software that has been paid for rather than an alternate version. |

Legal Action Resulting from Software Development Case Study
This case of Apple vs. Samsung was caused by Samsung copying Apple's tap-from-search technology allowing for quickly tap on a telephone number or address on the web and call that number or put the address into a map. Also, it is claimed that Google Quick Search Box is stolen from the patented d technology used by virtual assistant Siri to answer queries in the iPhone. It also claims patents on auto-correction when words are typed. In addition, Apple says Samsung copied "Slide to Unlock," which allows users to swipe the face of their smartphone to use it. Since it is believed that Samsung has stolen all these ideas and used them in their phones a $40 royalty from each phone using copied features which comes to a total sum of $2bn. This is the legal action taken by Apple resulting from the software stolen by Samsung.
